Welcome to Ordermaxx. These Terms of Service ("Terms") are a contract between you and Save Smart Group PTY LTD ("we", "us"), a company registered in South Africa at 71 Queen Victoria Street, Cape Town, the publisher of the Ordermaxx mobile application ("Ordermaxx", "the app").
By downloading, installing, or using the app you agree to these Terms. If you don't agree, please don't use the app.
1. Who can use Ordermaxx
You must be at least 13 years old to use Ordermaxx. If you're under 18, you confirm that a parent or legal guardian has reviewed these Terms with you.
2. What Ordermaxx does
Ordermaxx helps you make smarter food choices when eating out or ordering in. It lets you:
- Find restaurants near you
- View AI-extracted menus with estimated calories and macronutrients
- Scan a physical menu and get the same breakdown
- Save items you like
- Generate a year-in-review of your eating habits (if you import order data)
- Receive personalised recommendations tuned to a dietary goal
We may add, change, or remove features at any time.
3. ⚠️ Ordermaxx is not medical advice
This is the most important section. Please read it.
Ordermaxx is a general-wellness tool. It is not a medical device, dietitian, doctor, or registered nutritionist. The information shown in the app, including but not limited to:
- Calorie counts
- Protein, carbohydrate, fat, sugar, fibre, and sodium values
- "Healthy" / "not healthy" ratings
- Goal-based recommendations
- Daily targets
…is estimated and is intended for general informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
Do not rely on Ordermaxx to make decisions about:
- Medical conditions, including diabetes, heart disease, eating disorders, or food allergies
- Pregnancy or breastfeeding nutrition
- Medication interactions
- Specific therapeutic diets prescribed by a healthcare professional
Always consult a qualified healthcare professional before making significant changes to your diet, especially if you have a medical condition or are taking medication. If you have a food allergy, never rely on Ordermaxx alone — always confirm ingredients directly with the restaurant before you order.
If you think you may be having a medical emergency, call your local emergency number immediately.
4. AI-generated and third-party content
A lot of what you see in Ordermaxx is generated or sourced automatically:
- Menu data is extracted from restaurant websites and PDFs using AI (Anthropic's Claude). When direct nutrition data isn't available we use AI to estimate it from item names, descriptions, and similar dishes.
- Restaurant photos, ratings, and review snippets come from Google Places.
- Menu photos you scan are interpreted by AI, which can misread items, prices, or portions.
This means the data in the app can be:
- Wrong (the AI made a mistake)
- Out of date (the restaurant changed its menu)
- Incomplete (some items or modifiers are missing)
- Inconsistent (two scans of the same menu may differ)
We make a good-faith effort to keep things accurate but we make no guarantee that any specific item, price, or nutrition value is correct. Verify anything that matters with the restaurant directly.
5. Your profile and data
Ordermaxx does not have user accounts. Your profile (age, sex, weight, goals, preferences, saved items, etc.) is stored on your device only. You can erase all of it at any time by tapping Profile → Delete account. See our Privacy Policy for full details.
6. Subscriptions and payments
Some features of Ordermaxx require a paid subscription. The following terms apply to all subscriptions:
6.1 How billing works
- Subscriptions are processed by Apple through the App Store using your Apple ID.
- The current subscription title, length, and price will be shown on the in-app purchase screen before you confirm.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions auto-renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
6.2 Free trials and introductory offers
If your subscription includes a free trial or introductory offer:
- The offer applies only to new subscribers as defined by Apple.
- You can use the app's premium features during the trial.
- At the end of the trial the subscription automatically converts to a paid subscription and your Apple ID will be charged the regular price unless you cancel at least 24 hours before the trial ends.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
6.3 How to cancel
You can cancel anytime by going to iOS Settings → [your name] → Subscriptions → Ordermaxx → Cancel Subscription, at least 24 hours before the next renewal date. Cancellation takes effect at the end of the current billing period — you keep access until then.
6.4 How to restore
If you've previously subscribed, tap Profile → Restore purchases in the app. This re-checks your Apple ID for an active subscription.
6.5 Refunds
All payment, refund, and billing inquiries must be made directly to Apple via https://reportaproblem.apple.com. We cannot process refunds for App Store purchases ourselves.
6.6 Price changes
We may change subscription prices for future billing periods. Where required by law we'll give you notice and the opportunity to cancel before the change takes effect.
7. Acceptable use
When using Ordermaxx you agree not to:
- Use it for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the app's source code
- Scrape, mirror, or otherwise harvest data from our backend at scale
- Submit photos or content that is not a menu (e.g. obscene, illegal, or copyrighted material)
- Use the app to impersonate any restaurant or business
- Interfere with the app's security or with other users' experience
- Use automated tools to access the app or its backend
We may suspend or terminate your access to the app and any subscription if you breach these rules.
8. Intellectual property
Ordermaxx, including its design, code, branding, and content (other than third-party content such as restaurant names, menus, and Google Places data), is owned by us and protected by copyright and trademark laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes, subject to these Terms.
Restaurant names, logos, and menus are the property of their respective owners and are used in the app for informational purposes only. We are not affiliated with any restaurant unless explicitly stated.
9. Third-party services
The app may link to or surface content from third-party services (Google Places photos, restaurant websites, App Store, etc.). We are not responsible for the content, privacy practices, or terms of those services. Your use of them is governed by their own terms and policies.
10. Disclaimers
To the maximum extent permitted by law, Ordermaxx is provided "as is" and "as available", without warranties of any kind — express, implied, or statutory — including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the app will be uninterrupted, secure, or error-free.
Specifically, we don't warrant that:
- The nutrition, calorie, ingredient, or allergen data shown is accurate, complete, or up to date
- Recommendations will help you achieve any specific health, weight, or fitness outcome
- The app will be available at any specific time or work on any specific device
You use Ordermaxx at your own risk and discretion.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or relating to your use of (or inability to use) Ordermaxx.
In particular, we are not liable for any harm caused by reliance on nutrition, allergen, ingredient, or recommendation data shown in the app, including (without limitation) allergic reactions, medical complications, or weight changes.
Our total aggregate liability arising out of or relating to these Terms or the app will not exceed the greater of (a) the amount you paid us through the App Store in the 12 months preceding the event giving rise to the liability, or (b) USD 25.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the app.
13. Termination
You can stop using Ordermaxx and delete it at any time. We can suspend or terminate your access to the app or any subscription feature if:
- You breach these Terms
- We're required to by law
- We discontinue the app
Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability, indemnification, governing law) will continue to apply after these Terms end.
14. Apple's specific terms
Because Ordermaxx is distributed through the Apple App Store, the following applies:
- These Terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Beyond that, Apple has no warranty obligation. Any other claims, losses, liabilities, damages, costs, or expenses attributable to the app are our responsibility, not Apple's.
- We (not Apple) are responsible for addressing any claims that the app or your use of it infringes a third party's intellectual property rights.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Effective date" above and, where the change is significant, notify you inside the app. Continued use of the app after the effective date means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of South Africa, without regard to its conflict-of-laws rules. You and we agree that any dispute will be brought exclusively in the courts of Cape Town, South Africa, except where mandatory consumer-protection law gives you the right to bring a claim in your country of residence.
Nothing in these Terms limits any non-waivable rights you have under the consumer-protection laws of your country.
17. Miscellaneous
- If any provision of these Terms is found unenforceable, the rest will remain in effect.
- Our failure to enforce a right is not a waiver of that right.
- You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.
- These Terms (together with the Privacy Policy) are the entire agreement between you and us about the app.
